A Master's Thesis from the College of Law and Political Science Discusses The Claim of Defects of Consent in Formal Contracts

A Master's thesis from the College of Law and Political Science, entitled: "The Claim of Defects of Consent in Formal Contracts: A Comparative Study," by researcher Nour Bahjat Majeed, was discussed in Hammurabi Hall at the College of Law and Political Science.

The discussion committee consisted of the following professors:
1. Prof. Dr. Amer Ashour Abdullah / University of Al-Hamdaniya / University Presidency... Chairman
2. Prof. Dr. Hala Salah Yassin / University of Kirkuk / College of Law and Political Science...
3. Asst. Prof. Dr. Muhannad Baniyan Saleh / University of Kirkuk / College of Law and Political Science... Member
4. Prof. Dr. Ziad Khalaf Alawi / University of Kirkuk / College of Law and Political Science ... Member and Supervisor

The thesis, which was discussed in the presence of the Dean of the College of Law and Political Science, Assistant Professor Dr. Murad Saeb Mahmoud, aimed to demonstrate the extent to which defects of consent can be upheld in formal contracts, mitigate the severity of formality and avoid overemphasizing it, and remove the obstacles facing those whose will is marred by defects of consent. The thesis argued that the fulfillment of formality purifies the formal act from all aspects.

The thesis concluded that Iraqi law differed in its consideration of apparent and implicit will, sometimes adopting the implicit will and other times adopting the apparent will. It also stated that Iraqi law regulated legal formalism, but not the contractual formalism in its texts. It did not regulate the dispute over whether the contractual form was for proof or for conclusion.
